22.3  Changes to the Service Delivery Plan

22.3.1  The Contractor shall be permitted to propose changes or amendments to the Service Delivery Plan provided:

(a)  any change or amendment to [sections]43 of the Service Delivery Plan shall be treated and assessed as a Contractor Change and accordingly be subject to Authority approval in accordance with Schedule 21 (Change Protocol); or

(b)  in respect of matters not set out in (a) above, such change or amendment to be submitted to the Authority for review pursuant to Schedule 9 (Review Procedure).

43  Relevant sections of the Service Delivery Plan to be agreed and set out here on a project specific basis.  In agreeing which parts of the Service Delivery Plan are to be covered by limb (a), Authorities should consider, for example, those elements of the Contractor's Proposals that were considered during (and had an effect on) the evaluation of Final Tenders.  The Contractor ought to have flexibility to manage day to day matters and which do not prejudice the Contractor's ability to provide the Services in accordance with the Contract nor create a Change in Revenue and/or Change in Costs.
