44 Consistency with the Contract Waste definition and related definitions is a vital project specific issue depending inter alia on the 'upstream' waste management arrangements in place or envisaged by the Authority. Note that it is not recommended that an exclusive right to receive waste arising is granted (see Section 3 of the Defra "Standardisation of waste management PFI contracts: guidance on SoPC4 derogations" (the "Defra Derogations Guidance") for a discussion on this issue) but see further WIDP's Direction of Travel guidance (December 2009) and the matters set out in the footnote to Clause 23.3 (Authority obligation to deliver).
