Most Contracts contain provisions under which the Contractor is obliged to provide and maintain all the equipment necessary to provide the Services and to use reasonable endeavours to ensure that all equipment and related Contracts can be assigned or novated to the Authority on expiry or termination of the Contract.
To help the Authority take the practical steps it needs to take over the Equipment on expiry or termination, it is useful if the Authority always has an up to date list of Equipment. The WIDP Contract (Clause 30) therefore obliges the Contractor to provide an updated list of equipment annually and to provide a final Equipment list six months prior to the expiry of the Contract.
The Contract Management Manual should highlight this obligation and record the date that the annual update it due so that the Contract Management Team can chase the Contractor if necessary.
