12  Some of the facilities are unavailable for use.

Defence Management

An area is unavailable if it fails to meet certain criteria and is consequently not used by the Department. In this case, deductions are made to Defence Management's fee. If the unavailability is sufficiently serious, then the fee will be reduced virtually to zero and the Department can also terminate Defence Management's contract. There are however certain circumstances where Defence Management is not penalised for the facilities' unavailability (Appendix 4).
