Union Recognition (Clause 1.5)

2.37  Clause 1.5 requires the Authority, so far as possible, and its existing third party contractors in relation to the employees who will be transferring to the Contractor to supply all relevant trade union recognition agreements to the Contractor prior to the transfer. The Contractor is responsible for ensuring that it and any relevant Sub-Contractors recognise any relevant trade unions to the same extent as they were recognised prior to the transfer. By virtue of Clause 1.5.2 the Contractor will also ensure that when the identity of a Sub-Contractor changes and there is a transfer, the new sub-contractor will be required to recognise the trade unions representing the Transferring Employees.
