3.9  Authorities will generally require assurance that any of the Contractor's staff, or persons performing the Services on behalf of the Contractor (e.g. Sub-Contractors and their staff) do not pose a threat to anyone on the Site. For example, in respect of projects involving education or social services provision, Authorities will be anxious to ensure any workers who may pose a potential danger to young children or vulnerable adults are not allowed to perform Services which will involve contact with such children or adults. For this reason a standard clause is usually inserted requiring the Contractor to ensure all persons who may be on the Site to perform any of the Services to be questioned about their convictions and a Criminal Records Bureau (CRB) check undertaken so that the Authority's consent will be a pre-requisite to allowing any person with a conviction or appearing on the list maintained by the CRB under the Protection of Children Act 1999 being allowed to perform such Services on the Site.

3.10  From November 2010 the Safeguarding Vulnerable Groups Act 2006 requires new starters in regulated activities to register with the Independent Safeguarding Authority ("ISA"). The Authority may therefore wish to include a further obligation on the Contractor to ensure all relevant persons are registered and that it will carry out checks as appropriate under this new regime.
