2.5  Right of Set-Off

2.5.1  The Authority shall have a right to set off against any payments due to the Contractor under this Agreement an amount equal to any overdue employer and employee contributions and other payments (and interest payable under the LGPS (Administration) Regulations 2008) due from the Contractor or from any relevant Sub-Contractor (as applicable) under the Contractor Admission Agreement.34

34  This clause seeks to mirror the right of set off which must be included in the Contractor Admission Agreement under regulation 6(9) of the LGPS (Administration) Regulations 2008. It also permits set for monies owed by the sub-contractor, and therefore is more favourable to the Authority.
