2.11  Contracts (Rights of Third Parties) Act 1999

2.11.1  The Authority and the Contractor or Sub-Contractor agree that clause [[  ]37 of this Agreement (Contracts (Rights of Third Parties) Act 1999)] shall not apply to this clause 2.

37 The Direction requires that so far as the terms of the Agreement relate to the securing of pension protection for an original transferring employee, such terms are enforceable by the employee (see 3.5 above for further details). This clause will need to be cross-referenced with the clause dealing with third party rights which will be found elsewhere in the Agreement.
