1.12 Statutory Requirements and non-statutory Guidance
The Contractor is to design, construct and operate the new and / or refurbished Stations in full compliance with all relevant current legislative requirements (whether statutory or otherwise), and in accordance with any changes to such legislation which are reasonably foreseeable at the date of the Project Agreement of which this Output Specification forms part..
A list of relevant standards and regulations, although not exhaustive, is attached in Part Two of this Output Specification. (Should any of these standards have been updated at the time of submission, the Contractor must work to the latest revision and notify the Authority accordingly.)
The Contractor shall obtain full and detailed planning consents for each of the new Stations and to adhere fully with any conditions imposed as part of the detailed planning consents. It shall be the responsibility of the Contractor to obtain full consent under the Building Regulations and to comply in every respect to any other associated statutory legislation. Further, the Contractor shall undertake all surveys necessary to ensure a valid planning consent is achieved at the earliest. These may include some or all of the following examples:
■ Archaeological survey;
■ Flora and fauna survey;
■ Bats survey;
■ Amphibians survey;
■ Highways / Traffic study;
■ Environmental Impact Study;
■ Green Travel Plan preparation;
■ Utility services study;
■ Open spaces survey;
■ Ground and Surface water survey; and
■ Geological survey
The Contractor is to be responsible for obtaining all other statutory consents required in respect of the Works and Services and for full compliance with all relevant legislation for the entire period of the concession.
