6  Limitations On Deductions

If the aggregate of the Service Performance Deductions and Unavailability Deductions calculated for a particular month exceeds the total Monthly Unitary Charge, the amount of deductions that the Authority may make cannot exceed the amount that causes the Monthly Unitary Charge to the Contractor to be reduced to zero for that month.  Additional deductions above this level for that month cannot be recovered in future months. Additionally the Service Performance Deductions are limited to 30% of the overall Monthly Unitary Charge.
