The Standard Solution
For a Standard Solution to be considered by the Fire and Rescue Authority or Police Authority, the Bidder should ensure that its Standard Solution is compliant with all the requirements and assumptions set out in these Instructions, even where Bidder's disagree with any of such requirements and assumptions (except to the extent that the Fire and Rescue Authority or Police Authority issues specific instructions to Bidders after the date of issue of this ISDS that any requirements or assumptions are to be amended or disclaimed, in which case the Standard Solution must comply with such amendments).
Failure to provide the information in accordance with Paragraph • may lead to the Fire and Rescue Authority or Police Authority rejecting the Bidder's submission.
A Standard Solution is a solution which accepts all of the terms of the Model Contract, based on the services specified, the required level of performance, and the risk transfer that the Model Contract assumes. Bidders will be required to confirm as part of their Standard Solution that they accept all of those terms.
If Bidders believe that they can only submit a sustainable Standard Solution with certain qualifications to the Model Contract, the Fire and Rescue Authority or Police Authority will accept as a Standard Solution one that is qualified to the minimum extent necessary. Bidders should note, however, that the Fire and Rescue Authority or Police Authority's strong preference is for an unqualified Standard Solution and that accordingly any such qualifications will be taken into account in the evaluation of Solutions and in subsequent stages of competitive dialogue.
Bidders should use the facility of submitting Variant Solutions to make alternative proposals that they believe will enable them to offer a more competitive Solution. A mark-up to the Model Contract must be contained in a Variant Solution, and each and every item of mark-up must be accompanied by a completed entry in a table in the format set out at in Solution Form 2 in Appendix 9 of these Instructions.
As is to be expected, there will remain (limited) parts of the Model Contract to be fine-tuned. These include, for example, [insert details]. These Clauses are procedural Clauses, not substantive Clauses which allocate commercial risk. Procedural Clauses (or Clauses containing typographical errors or mistakes) may be subject to further amendment, at the request of the Bidder or the Fire and Rescue Authority or Police Authority.
