Legal and Contractual Requirements
The Fire and Rescue Authority or Police Authority is seeking to achieve the optimal transfer of risk and responsibility to the Service Provider whilst recognising and taking into account the fact that certain risks are best retained by the Fire and Rescue Authority or Police Authority, or shared between the Fire and Rescue Authority or Police Authority and the Service Provider
The Risk Register included at Appendix 7 to these Instructions sets out a summary of the risks which the Fire and Rescue Authority or Police Authority has identified in relation to the project and the Fire and Rescue Authority or Police Authority's view of which risks should be borne by the Fire and Rescue Authority or Police Authority and which risks should be borne by the Service Provider. The allocation of risk as shown in the Risk Register is embodied in the Model Contract. Notwithstanding the foregoing, Bidders should note that the Model Contract takes precedence over the risk allocation shown in the Risk Register.
