5  Time periods for approval

5.1  Each Draft Business Case and each Full Business Case shall be valid for a period of three months from the date of its submission to the Authority by the Service Provider.  

5.2  If by the end of the three month period referred to in paragraph 5.1 the Authority has not:

(a)  in relation to a Draft Business Case, approved or rejected that Draft Business Case in accordance with the procedures set out in this Schedule 15 (or has not given any notification of the Authority's response to the Draft Business Case) then:

(i)  the Service Provider shall be entitled to withdraw the Draft Business Case at the end of that period; and

(ii)  the Service Provider shall not be entitled to any costs relating to the Draft Business Case;

(b)  in relation to a Full Business Case, approved or rejected that Full Business Case in accordance with the procedures set out in this Schedule 15 (or has not given any notification of the Authority's response to the Full Business Case) then paragraph 4.8 shall apply.
