39.6  Consequences of Termination

If this Agreement is terminated under clause 39.5 (Failure to Agree) or clause 39.7 (Notice to Continue):

39.6.1  compensation shall be payable by the Authority in accordance with clause 42 (Compensation on Termination for Force Majeure); and

39.6.2  the Authority may require the Contractor to transfer its title, interest and rights in and to any Assets to the Authority or as directed by the Authority.
