54.1  Right to Step-In

If the Authority reasonably believes that it needs to take action in connection with the Services:

54.1.1  [or the Works]257 because a serious risk exists to the health or safety of persons or property or to the environment; and/or

54.1.2  [or the Works]258 to discharge a statutory duty,

54.1.3  to enable the collection of rent from Tenants in circumstances where for [  ] consecutive months the [average] level of rent arrears for the period of [twelve] [12] months up to and including each of those months calculated in accordance with the Output Specification is greater than [minimum acceptable performance] for [  ] consecutive months];259

54.1.4  to enable the collection of service charges from Leaseholders in the circumstances where for [   ] consecutive months the [average] level of service charge arrears for the period of [12] months up to and including each of those [  ] months calculated in accordance with the Output Specification is greater than [minimum acceptable performance] for [ ] consecutive months;260

54.1.5  where a Dwelling has not been made Available for a period of [  ]save where the Contractor has commenced Works or other actions sufficient to restore Availability unless, having commenced such Works or other actions, the Authority naturally believes that the Contractor is likely to complete (or to have completed) them within the period of [  ].] 261

then the Authority shall be entitled to take action in accordance with clauses 54.2 (Notice to the Contractor) to 54.5 (Step-In on Contractor Breach).
