56.4  Tenant Damage and Third Party Damage

The Authority and Contractor will comply with the provisions of the Tenant and Third Party Damage Protocol in relation to Tenant and Third Party Damage.]276

276  Where housing management is included in the project then the presumption should be that tenant damage should be a Contractor risk.  However, there may be occasions where it is demonstrated to be better value for money for the Authority to share this risk.  Where this is the case, a specimen protocol is included at Appendix 1.
