Commencement and Duration of Unavailability
3.5. If the Contractor does not remedy any Unavailability within the relevant Rectification Period then that Unavailability will be deemed to have commenced on the date that such Unavailability was notified in accordance with paragraph 3.4. Where any Unavailability is notified after 12.00 noon, the Period of Unavailability shall be deemed to commence on the following day.
3.6. Any Unavailability is deemed to continue for the purpose of calculating Unavailability Deductions until the point in time when the dwelling becomes Available. The time when the dwelling becomes Available shall be determined through a self-certification of Availability by the Contractor. The day that the Dwelling is recorded as Available shall required to be certified as Available prior to 12.00 midday, otherwise the day shall be counted as Unavailable.
3.7. Where there is an incidence of two or more notifications of Unavailability at the same Dwelling, each day that the Dwelling is Unavailable, shall only be counted once.
3.8. There shall be no requirement to notify the Contractor pursuant to paragraph 3.4 for each day for which a Dwelling remains Unavailable if such Unavailability continues for more than one Day as a result of the continuation of circumstances which gave rise to the Unavailability on the first day.
