Consequential Unavailability

3.12.  Where an instance of Consequential Unavailability occurs, the Dwellings that are subject to the Consequential Unavailability shall be deemed to be Unavailable until the Unavailability of the Facility has been rectified.  An Unavailability Deduction Factor shall be applied to the relevant Dwelling(s), which shall be commensurate with the severity of the Consequential Unavailability. Where a Dwelling is Unavailable after the Relevant Rectification Period has expired is not due to Consequential Unavailability, the Unavailability Deduction Factor shall be 1.

3.13.  For the avoidance of doubt, deductions of the Unitary Charge will only apply to Dwellings for Facilities that are deemed to be Unavailable, not to the Facility that is Unavailable.  

3.14.  Consequential Unavailability will include (but not be limited to):

(a)  the Dwellings directly affected by a roof leak (which may include more than one Dwelling but is unlikely to directly impact all Dwellings in a multi‑ level property).

(b)  all Dwellings serviced by a failed lift (excluding ground floor Dwellings whose access will not be affected by the failure of the lift).  

(c)  main door access (for example in residential/care buildings effecting the access to all Dwellings)
