8. Tenant Waiver Event
8.1 In the event of the Tenant refusing to be Decanted or a Tenant being unable to be Decanted due to his or her vulnerable condition, the Contractor having complied with the provisions of this Decant Protocol, there will be a Decant Refusal Event and the Dwelling will be placed on the Access Refusal and Tenant Waiver Waiting List and paragraphs 2.3.2(f) and (g) of the Access Protocol will apply.
8.2 The Decant Refusal Event shall come to an end upon the earlier of either the Tenant agreeing to be Decanted or the Tenant vacating the Dwelling.
8.3 Should for whatever reason the Authority require the elements of the [Initial Refurbishment] Works required following the end of the Decant Refusal Event as defined in paragraph 8.2 above to be carried out to any particular Dwelling in addition to the [number] annually due to be carried out under the Access Refusal and Tenant Waiver Waiting List procedure then a Pass Through Cost of £[number] [indexed] per Dwelling will be required to be paid by the Authority to the Contractor.
