51.4  Deductions

Nothing in clause 51.3 (Consequences) shall affect any entitlement to make Deductions or deductions made under clause 33 (Payment Provisions) and Schedule 4 (Payment Mechanism) during the period in which the Relief Event is subsisting [provided that any such deductions shall be disregarded for the purposes of the Authority's right to terminate this Agreement for a Contractor Default].261

261 If the termination levels under the Agreement for non-performance are connected to the deductions made under the Agreement or the award of performance points, the Agreement should ensure that deductions or points arising due to non-performance caused by Relief Events are not taken into account in the termination provisions of the Agreement.
