Repeated Unavailability

3.15.  On the day that Rectification of Unavailability has occurred, a Repeated Unavailability Cycle Period will be triggered. If a Repeated Unavailability event occurs within the Repeated Unavailability Cycle, the Dwelling will automatically be deemed to be Unavailable upon notification with no relevant Rectification Period unless a subsequent Rectification Period is identified in the Output Specification, in which case the dwelling will be deemed to be Unavailable from the point of notification if the failure is not rectified within that subsequent Rectification Period, and will continue to be Unavailable until the Unavailability has been remedied. A Repeated Unavailability Ratchet shall be applied to the Unavailability Deductions, which cumulatively increases with the number of days that a Dwelling is Repeatedly Unavailable. The number of days that a Dwelling will be deemed to be Repeatedly Unavailable shall continue until the Repeatedly Unavailable Ratchet is reset to 1.   

3.16.  Where no Repeated Unavailability Event occurs within the Repeated Unavailability Cycle, the Repeated Unavailability Ratchet will be reset to 1.

3.17.  The Repeated Unavailability Ratchet will also apply where the failure has not been rectified within the relevant Rectification Period and has continued not to be rectified for consecutive days.

3.18.  The Repeated Unavailability Ratchet will be multiplied by the number of days that the Dwelling is Unavailable or Unavailable but Used in the Contract Month. The Repeated Unavailability Ratchet will increase by the cumulative number of days during which the Dwelling is Repeatedly Unavailable which will have been recorded from the first point of Unavailability or Consequential Unavailability.

3.19.  The Contractor shall comply with the requirements of the Unavailability Reporting Timetable in submitting an Unavailability Monitoring Report for each Contract Month to the Authority.  The Unavailability Monitoring Report should contain, but not limited to, the following:

(a)  the actual instances of Unavailability of Dwellings during the relevant Measurement Period;

(b)  the Unavailability Deductions for the Contract Month calculated in accordance with this Part III;

(c)  any corrections to the Unavailability Monitoring Report submitted in the previous Contract Month.

3.20.  In addition the Contractor shall supply such information on Unavailability as shall be required to comply with the Output Specification in accordance with the timetable outlined in the Output Specification.
