Notice of Sub-Standard Performance

4.2.  The Authority shall procure that any Authority Related Party promptly notifies the Helpdesk of any circumstances of which they become aware which constitute or may lead to sub-standard performance.

4.3.  No failure by any person (including the Authority, Authority Related Party, Tenant or Leaseholder) to notify the Contractor pursuant to this paragraph 4 shall relieve the Contractor of its obligations under this Agreement.

4.4.  Each KPI Table in Part VII defines the KPI which is to be measured, further detail in relation to which is given in the Output Specification.  The Contractor shall procure that each Service is monitored at all times after Contract Commencement and all information required for measurement of the KPIs is recorded in a timely manner.
