2.  Tree Works - General

2.1  Tree works shall be the responsibility of the Contractor in accordance with the terms of this protocol.

2.2  The Contractor shall employ [Arboriculturalist], or any successor contractor appointed by the Authority as its tree works sub-contractor under a Service Level Agreement.

2.3  In the event that agreement on the terms of a Service Level Agreement cannot be reached by the Contractor and [Arboriculturalist], then the Contractor shall have the option of appointing an alternative tree works sub-contractor.

2.4  Any remedies claimable by the Contractor under the Service Level Agreement shall be claimable against the Authority.

2.5  [Arboriculturalist] shall undertake a tree survey in the form suggested by the attached draft brief commencing from [  ].

2.6  The Authority shall fund such tree works (including cyclical pruning) separately from this Agreement and the Contractor shall manage such tree works and cyclical pruning to the extent that the budget provided by the Authority allows.

2.7  The Service Level Agreement shall require [Arboriculturalist] to operate in accordance with the Authority's Tree Policy and shall provide for dispute resolution (including independent arbitration) to apply should a conflict arise regarding [Arboriculturalist] interpretation of such policies.

2.8  Applications to work on trees protected by Tree Preservation Orders (TPOs) shall be managed by [Arboriculturalist].

2.9  The parties shall consider the need for future tree survey work during the Contract Period.  The undertaking of such a tree survey shall be subject to the Authority agreeing to fund such a tree survey.
