Requirements for Solutions
• For both the Standard Solution and any Variant Solutions, written confirmation is required from the Bidders that any comments represent the views of all members of the Bidder's consortium, including the Funder
• For a Standard Solution, a clear confirmation is required that the Bidder agrees with the Local Authority's proposed allocation of risk as embodied in the Model Contract, or if it does not, an explanation of the qualifications in accordance with Paragraph • of these Instructions
• For a Variant Solution, a completed Solution Form 2 (as set out in Appendix 9 of these Instructions) and a mark-up of the Model Contract in accordance with Paragraph • of these Instructions is required
• A description of the key Contracts to be entered into by the Service Provider is required, together with a diagram defining the relationship between the various parties. Any Contracts proposed, inter alia, in respect of design, build/refurbishment/installation, commissioning, operation and maintenance, shall be entered into by the Service Provider prior to, or at the time of execution of the PFI Contract.
• For both the Standard Solution and any Variant Solutions, a description of how the duties of the Client for the purposes of the CDM Regulations will transfer from the Local Authority to the Service Provider and will be subsequently discharged by the Service Provider.
