9.4  No Contractor Default

Under no circumstances may any breach in respect of the performance of the Initial Services be capable of giving rise to a Contractor Default.89

89 Authorities are to decide whether the FM Contractor ought to be barred from providing Services if performance is sufficiently poor during Initial Services, or whether it only ought to be barred from providing Initial Services.
