Accrual of Additional Project Network Parts

4.3  If additional Authority works were carried out between the Contract Date and the Planned Service Commencement Date than anticipated by the Authority Scheduled Works resulting in additional Project Network Parts then the Service Provider shall:

(a)  use reasonable endeavours to mitigate any ongoing maintenance costs (including future costs) arising from the additional Project Network Parts; and

(b)  provide evidence to the Authority to show that the additional Project Network Parts will, notwithstanding clause 4.3(a) lead directly to an increase to the ongoing maintenance costs of the Project Network,

and the additional Project Network Parts referred to in clause 4.2 shall be Accrued to the Project Network with effect from the Service Commencement Date pursuant to the provisions of Schedule 14 (Accrual and De-Accrual Process) but such additional Accrued Project Network Parts shall not count towards the limits set out in paragraph 6 of Schedule 14 (Accrual and De-Accrual Process).
