De-Accrual where fewer Project Network Parts

4.4  If fewer Authority works were carried out between the Contract Date and the Planned Service Commencement Date than anticipated by the Authority Scheduled Works resulting in fewer Project Network Parts then the Service Provider shall:

(a)  use reasonable endeavours to ensure a corresponding reduction in any ongoing maintenance costs (including future costs) arising from there being fewer Project Network Parts; and

(b)  provide evidence to the Authority to show that there being fewer Project Network Parts will, notwithstanding clause 4.3(a) not lead directly to a corresponding decrease to the ongoing maintenance costs of the Project Network,

and the fewer Project Network Parts referred to in clause 4.2 shall be De-Accrued to the Project Network with effect from the Service Commencement Date pursuant to the provisions of Schedule 14 (Accrual and De-Accrual Process) but such additional De-Accrued Project Network Parts shall not count towards the limits set out in paragraph 6 of Schedule 14 (Accrual and De-Accrual Process).
