5.3  Service Provider to Demonstrate Compliance

Following notification by the Service Provider in accordance with clause 5.2 that the Mobilisation Requirements have been met:

(a)  the Authority shall, within two (2) Business Days of receipt of such notification, serve written notice on the Service Provider either:

(i)  requiring the Service Provider to demonstrate, within two (2) Business Days of such request, to the Authority's reasonable satisfaction, that the Service Provider has met the Mobilisation Requirements; or

(ii)  confirming the Authority's satisfaction that the Mobilisation Requirements have been met;

(b)  where the Authority serves a notice pursuant to clause 5.3(a)(i), after the demonstration referred to therein, the Authority shall serve a further written notice on the Service Provider either:

(i)  stating it is not reasonably satisfied that the Mobilisation Requirements have been met and such notice shall include the Authority's reasons for its decision; or

(ii)  confirming the Authority's satisfaction that the Mobilisation Requirements have been met;

(c)  where the Authority serves written notice pursuant to clause 5.3(b)(i) the Service Provider shall take all necessary steps to ensure that the Mobilisation Requirements are met and shall serve a further notice on the Authority to that effect and clauses 5.3(a) to 5.3(c) (inclusive) shall apply until the Authority is reasonably satisfied that the Service Provider has met the Mobilisation Requirements and serves a notice to that effect.
