5.4  Delay in meeting Mobilisation Requirements

If the Service Provider notifies the Authority pursuant to clause 5.2 that it has not met the Mobilisation Requirements, the Service Provider shall:

(a)  include in the notice served pursuant to clause 5.2 details of the date when the Service Provider expects to have met the Mobilisation Requirements (the Intended Service Commencement Date); and

(b)  the provisions of clauses 5.2 to 5.5 (inclusive) shall apply as if references to the Planned Service Commencement Date were references to the Intended Service Commencement Date.
