5.5  Non Service of Notice

Where the Authority does not serve a notice pursuant to clause 5.3, then the Service Commencement Date shall be the Planned Service Commencement Date or the Intended Service Commencement Date (as the case may be) provided that the failure of the Authority to serve a notice shall not relieve the Service Provider of its obligation to meet the Mobilisation Requirements.
