8.4  Trials

Any study or trial referred to in clause 8.2(d)(iii) shall be conducted in such manner as to minimise the loss of availability of any road or any adverse effect on traffic flows on the Project Network and no such study or trial shall, without the consent of the Service Provider (such consent not to be unreasonably withheld or delayed), substantially affect the physical integrity of the Project Network.  The occurrence of such study or trial shall constitute an Excusing Cause and the provisions of clause 40 (Excusing Causes) shall apply.
