14.1  Certification of Milestone Completion

No later than five (5) Business Days before the Service Provider believes any Milestone (or element of a Milestone) will be Complete:

(a)  the Service Provider shall give written notice to Independent Certifier (copied to the Authority Representative) specifying the relevant Project Network Parts to be inspected (an Inspection Notice);

(b)  following receipt of the Inspection Notice the Independent Certifier shall inspect the relevant Project Network Parts specified in the Inspection Notice to determine whether or not such items are Complete.  Such inspection shall occur on the date or dates specified by the Service Provider in the Inspection Notice provided that such date or dates shall be a Business Day and the inspection shall not occur prior to the date which is five (5) Business Days after the date of the Inspection Notice;

(c)  when he is satisfied that the relevant Project Network Parts are Complete, the Independent Certifier shall issue a Milestone Completion Certificate together with a Snagging List (if applicable) to each party within two (2) Business Days of inspecting the relevant Project Network Parts;

(d)  the Independent Certifier shall be entitled to make any enquiry or test, or conduct any investigation he sees fit to satisfy himself that any relevant Project Network Part is Complete; and

(e)  the Authority Representative and any nominee of the Authority shall be entitled:

(i)  to attend any inspection, enquiry, test or investigation by the Independent Certifier; and

(ii)  provide to the Independent Certifier (copied to the Service Provider) any information relevant to the certification process and such information shall be taken into account by the Independent Certifier in considering whether to issue a Milestone Completion Certificate.
