17.1  Property of the Authority

Notwithstanding clause 17.2:

(a)  the Existing Apparatus shall remain the property of the Authority;

(b)  all New Apparatus shall become the property of the Authority upon either:

(i)  the date when such New Apparatus is certified pursuant to clause 14 (Certification of Milestones and Subsequent Works) or

(ii)  if the New Apparatus is not certified, subject to clause 18.2 (Incomplete Apparatus) on the earlier of the Termination Date or the Expiry Date;

and the Service Provider shall carry out, or procure the carrying out, of all actions necessary to ensure the rights, title and interest in, and to, the Apparatus transfer to the Authority on the relevant date set out in this clause 17.1.
