21.3  Service Provider to Bear Loss

Subject to clause 21.4, the Service Provider, shall reimburse any Losses suffered by any person arising out of a failure by the Service Provider to deliver the Service as a result of any circumstance set out in clause 21.1, provided that nothing in this clause 21.3 shall affect:

(a)  any right of the Authority to make or recover pursuant to any Claim against any  Protester or Trespasser for damage suffered by the Authority or any Authority Party, or

(b)  any right of the Service Provider to make or recover pursuant to any Claim against any Protester or Trespasser for damage suffered by the Service Provider or any Service Provider Party
