24.2  Notice of Latent Defect

The Service Provider shall, as soon as it becomes aware of any Latent Defect, notify the Authority in writing (a Latent Defect Notice) of the following matters:

(a)  the type of the Latent Defect, including details of the affected [Project Network Part] [Structure, Tunnel, Bridge or Key Structure] and the affected parts thereof;

(b)  any further inspections, tests, surveys and/or assessments necessary to assess the affected [Structure, Tunnel, Bridge or Key Structure] and any inspections, tests, surveys and/or assessments necessary to assess any similar [Structure, Tunnel or Bridge] that may be affected by a similar Latent Defect;

(c)  any measures adopted by the Service Provider in order to prevent the Latent Defect from deteriorating in the period before rectification work commences;

(d)  an estimate of the timeframe for rectification of the Latent Defect;

(e)  traffic management measures, including road closures, diversions, restricted access to roads and any closure or restrictions on pedestrian thoroughfares, that the Service Provider has taken, or intends to take;

(f)  any further measures that the Service Provider has taken, or intends to take in order to manage any immediate or potential health and safety risk to the public;

(g)  whether or not Latent Defects have occurred previously in the affected [Structure, Bridge, Tunnel or Key Structure], and if so, giving full details of the amount of Latent Defect Costs incurred to date;

(h)  an estimate of the likely Latent Defect Costs and details of whether, and if so by how much, the Latent Defects Cap or Key Structure Latent Defects Cap (as the case may be) will  be exceeded.
