26.5  Duty to Mitigate

The Service Provider shall not be relieved of its liability pursuant to clause 26.4 to the extent such liability could have been avoided by the Service Provider taking all steps necessary to mitigate the effects of the refusal or delay of the Authority to take the requested action but was not so avoided because the Service Provider failed to take such steps.
