28.1  Standard of Service20

The Service Provider shall provide the Service continuously from the Service Commencement Date and throughout the remainder of the Contract Period:

(a)  in accordance with Good Industry Practice;

(b)  in order to comply fully with the Output Specification;

(c)  in a manner consistent with the Method Statements;

(d)  in accordance with the Service Provider Programmes;

(e)  in accordance with all Necessary Consents;

(f)  in accordance with all Law and Guidance and [Highways Standards and Relevant Lighting Standards]21;

(g)  in accordance with the other provisions of this Contract;

(h)  in accordance with the Authority's obligations under the Rail Agreement in so far as that is required in order to comply with the Output Specification; and

(i)  in order to, subject to clause 9 (Traffic Management and Road Closures) and clause 10 (Special Event Closures), keep the Project Network open for public use;

(j)  without prejudice to clause 25.9 (Primary Duty of Co-Ordination), so as not to interfere unnecessarily with the convenience of:

(i)  the public or the access to, use and occupation of public or private roads or footpaths, footways or bridleways, whether under the control or in the possession of the Authority or any other person;

(ii)  the users of any areas of the Project Network not being used for highway or access purposes; or

(iii)  the owners or occupiers of land or persons benefiting from Land Rights in respect of land adjacent to the Project Network.; and

(k)  in a manner which shall:

(i)  secure the safety of users of the Project Network, workers or other persons on the Project Network or on land adjacent to the Project Network or using adjoining roads or facilities;

(ii)  enable the Authority to fulfil its statutory duties and functions in relation to the Project Network and not place the Authority in breach of any Law relating to the Project Network; and

(iii)  not impair the ability of others with statutory duties or functions in relation to the Project Network to perform those duties and functions.
