35.1 Notice by Authority
35.1 Where the Authority, acting in its capacity as a Highway Works Authority, proposes to undertake or procure the undertaking of any works and/or management not specifically dealt with by any other express provision of this Contract within or about the Project Network and the Authority does not (in its discretion) require those Project Network Parts to be De-Accrued pursuant to Schedule 14 (Accrual and De-Accrual Process) the Authority shall:
(a) where such works are Street Cleansing, not be required to notify the Service Provider in advance of carrying out such works;
(b) where such works are:
(i) Small HWA Works, issue a notice to the Service Provider at least five (5) Business Days (or such other period as the Authority may, acting reasonably, consider appropriate); or
(ii) Major Highway Works, issue a notice to the Service Provider at least twenty (20) Business Days (or such other period as the Authority may, acting reasonably, consider appropriate),
prior to the Authority Work Start Date;:
(c) the notice referred to in clause 35.1(b) shall specify:
(i) the affected part of the Project Network;
(ii) the date upon which the works are due to commence (the Authority Work Start Date); and
(iii) a reasonable estimate of the completion date of such works (the Authority Work End Date) provided that the same may be altered by the Authority (acting reasonably) giving further written notice of to the Service Provider as soon as reasonably practicable.
