46.5  Non Implementation

If the Authority determines that it does not require the Service Provider to implement a proposed Change in Highways Standards (whether pursuant to clause 46.2 or clause 46.4), such proposed Change in Highways Standards shall not be deemed to be a Change in Highway Standards (for the purposes of this Contract) and the Service Provider shall continue to comply with the Highways Standards as if such proposed Change in Highway Standards had not occurred.
