48.9  Dispute Resolution

Without prejudice to either party's rights under the Dispute Resolution Procedure the parties shall use all reasonable endeavours to reach agreement in respect of any Disputed Sum.  Unless agreed otherwise by both parties, if agreement has not been reached in relation to the Disputed Sum, three (3) Business Days prior to the date upon which the invoice to which it relates becomes payable under clause 48.7, the dispute shall be resolved under the Dispute Resolution Procedure and the relevant party shall pay the Monthly Payment save for the Disputed Sum in accordance with clause 48.7.
