52.6 Human Rights Act Indemnity for any Loss or Claim
The parties acknowledge and agree that the Service Provider may be acting as a public authority for the purposes of the Human Rights Act 1998. If in any proceedings brought under the Human Rights Act 1998 any Claim is made against the Authority or any Losses are suffered by the Authority such Claim or Losses:
(a) arises out of the performance by the Service Provider of its obligations under this Contract; or
(b) arises out of any act or omission of the Service Provider or any Service Provider Party
and the Service Provider shall fully and effectively indemnify and keep indemnified the Authority against any such Claim or Losses.
