54A.3  Compliance with the Code

If the contracts of employment of any Transferring Staff do transfer to the Service Provider or a relevant sub-contractor and such individuals remain in the employment of the Service Provider or such relevant sub-contractor notwithstanding the provisions of clause 54A.2, then the Service Provider shall, and shall procure that any sub-contractor complies with its or their obligations pursuant to the Code and the Service Provider shall (for itself and the relevant sub-contractor) indemnify the Authority in respect of any failure to do so.
