62.10  Termination by the Authority for Breach of the Refinancing Provisions

If the Service Provider wilfully breaches paragraph 2.1 of Schedule 23 (Refinancing) then the Authority may terminate this Contract pursuant to this clause 62.10 by serving a Termination Notice on the Service Provider stating:

(a)  that the Authority is terminating this Contract pursuant to this clause 62.10;

(b)  that this Contract shall terminate on the date falling twenty (20) Business Days after the date of receipt of the notice; and

(c)  whether the Authority elects not to take a transfer of the Assets pursuant to clause 67.6 (Transfer of Assets),

and this Contract shall terminate on the date falling twenty (20) Business Days after the date of receipt by the Service Provider of the notice.
