69.7  Failure to carry out work

If, and to the extent that, the Service Provider fails to carry out the Outstanding Works to reach the Required Standard to the Authority's reasonable satisfaction within the Specified Period, the Authority shall be entitled to carry out itself, or procure the carrying out of the Outstanding Works at the Service Provider's expense.  The Authority shall make withdrawals from the Retention Fund Account to pay for such work or, where there are insufficient funds in the Retention Fund Account make (subject to clause 48.12 (Set Off)), deductions from the Monthly Unitary Charge to pay for such rectification or maintenance works or recover such amount as a debt payable on demand.
