3.4  Delivery

Delivery

(a)  of all Project Assets purchased by the Service Provider (excluding Grit Bins in situ on the Project Network which are not in the Depot) shall be effected by:

(i)  the Service Provider taking possession of the same at the Depot on the Service Commencement Date; or

(ii)  if some other place for delivery within the Project Area is agreed by the Authority to the Service Provider prior to the Service Commencement Date, by the Authority delivering the relevant Project Assets to that place on the Service Commencement Date.  

(b)  of Grit Bins shall be made by the Authority notifying the Service Provider in writing, on the Service Commencement Date, that the Grit Bins (except for those Grit Bins that are available for collection in the Depot) are at the locations specified by the Authority in such written notice.
