3.6  Title

Notwithstanding paragraph 3.4 and paragraph 3.5 or any other provision of this Part 3 of Schedule 2 (Mobilisation), title in the Project Assets shall not pass to the Service Provider until the Service Provider has issued the invoice to the Authority in respect of the Monthly Payment for Month 1 in accordance with paragraph 3.3(b) unless there is a dispute pursuant to paragraph 3.3(c) in which case title shall pass to the Service Provider in respect of the Project Assets which relate to the Disputed Sum when such dispute is agreed or determined pursuant to the provisions of this Contract.
