4  Third Party Attachments

4.1  If the Service Provider causes damage to any Third Party Authority Attachment, the Service Provider shall indemnify the Authority against such loss or damage. The Service Provider shall not indemnify the Authority against any damage caused to any Third Party Attachment by any works to the extent that such works were carried out by the Authority or an Authority Party.

4.2  The Authority shall be responsible for any damage caused to any Project Network Parts by a Third Party Attachment or any works to a Third Party Authority Attachment and paragraphs 3.5 to 3.14 (Authority Attachments) (inclusive) shall apply as if reference to Authority Attachments has been replaced with reference to Third Party Attachments.

4.3  The Authority may instruct the Service Provider to install Third Party Attachments. Any instruction of the Authority requiring the Service Provider to install Third Party Attachments shall be deemed to be Small Works and shall be priced in accordance with the Small Works Rates.
