1  Definitions

In this Schedule 14 the following expressions (in addition to those specified in Schedule 1 (Definitions, Interpretation and Construction)) shall, save where the context or the express provisions of this Contract otherwise requires or admits, have the following meanings:

Accrual Adjustment means revision of the [Monthly] Unitary Charge to be made as a result of an Accrual or a De-Accrual.

Accrual Cap shall have the meaning given in paragraph 6.1(a) (Limitation of the Levels of Accruals and De-Accruals) of this Schedule 14.

Accrual Date means in respect of a Project Network Part the earlier of:

(a)   the date on which a Accrual Confirmation Notice has been agreed pursuant to paragraph 3.5 (Accrual of Project Network Parts) or has been deemed to have been issued pursuant to paragraph 3.4 (Accrual of Project Network Parts) of this Schedule 14; and

(b)   when paragraph 3.2(j)(i) or paragraph 3.2(j)(ii) applies the date the works are accepted or determined as being satisfactorily completed.

Accrual Notice shall have the meaning given in paragraph 3.2 (Accrual of Project Network Parts) of this Schedule 14.

Category 1 Defects means those defects in or on the Project Network that require prompt attention because they represent an immediate or imminent hazard or because there is a risk of short term structural deterioration.

De-Accrual Cap shall have the meaning given in paragraph 6.1(b) (Limitation of the Levels of Accruals and De-Accruals) of this Schedule 14.

De-Accrual Date shall have the meaning given in paragraph 4.1(e) (De-Accrual of Project Network Parts) of this Schedule 14.

De-Accrual Notice shall have the meaning given in paragraph 4.1 (De-Accrual of Project Network Parts) of this Schedule 14.

Draft Monthly Monitoring Report shall have the meaning given in Schedule 17 (Monitoring and Reporting) of this Schedule 14.

Forecast Energy Consumption shall have the meaning given in the Payment Mechanism.

Powered Apparatus means street lighting (including lighting columns, lighting points and tunnel lighting points), illuminated attachments, illuminated signage systems, illuminated traffic signals, traffic observation cameras, traffic observation camera columns, traffic observation camera poles, illuminated traffic signs and their traffic signal columns and traffic signal poles, traffic signal controllers, traffic signal heads, traffic signal poles, illuminated bollards, belisha beacons, VMS, EMS, loop detectors, smoke detectors, signalised pedestrian crossings, signalised pedestrian crossing equipment, remote monitoring systems, radio re-broadcast systems, pumping stations, aspect lamps, festive decorations, UTMC, detector equipment, electrical equipment, emergency points, EMS equipment, VMS equipment, ice early warning system, incident detection equipment, lamps, luminaires, metered apparatus, traffic management systems, underground cables, switchgear and connection, and any components included in all of the above.

Proposed Accruable Project Network Part means a Project Network Part which the Authority intends to Accrue and Proposed Accruable Project Network Parts shall be construed accordingly.

Accrual Confirmation Notice shall have the meaning given in paragraph 3.3 (Accrual of Project Network Parts) of this Schedule 14.

Road Section Length means the individual lengths of the Project Network between consecutive nodes as identified in the [Network Model].

Underground Apparatus means [♦].

Y value means those values set out in Appendix 1 to this Schedule 14.
