2.2.1  Obligations

The private party must ensure that each of the Conditions Precedent that it is responsible for satisfying is met by the target date for satisfaction of the Conditions Precedent.4 Depending on the project, government may require the private party to satisfy the Conditions Precedent at its cost.

4 The target date for satisfaction of the Conditions Precedent will be determined on a project specific basis depending on the nature of the Conditions Precedent to be satisfied, but is usually 60 business days from contractual close.
