9.1 Design obligations

(a) The private party must design the facility so that it will comply with the Project Contracts and so that it is at all relevant times fit for its intended purposes.

(b) The private party is not relieved of any of its design obligations by sub-contracting any of the design works to a design consultant or any other sub-contractor. Depending on the contract value, the private party must notify the government of, and give it access to, any such sub-contract.32
